Any restrictions you wish to impose on our use of such information must be communicated to us in advance, and we reserve the right to reject such conditions and associated information.

10. Accounts

10.1 In order to obtain services on this website and use certain other parts of the system, you must create an account that will contain certain personal data and payment information that may vary depending on your use of the website, as we may not request payment information until you wish to make a purchase. By continuing to use this website, you represent and warrant that:

10.1.1 all information you submit is accurate and true;

10.4 When choosing your username, you must adhere to the terms set out in Clause 9 above. Failure to comply with these terms may result in the suspension and/or deletion of your account.

11. Termination and Account Cancellation

11.1 Psycom’s refund policy is 30 days.

11.2 Psycom and/or you may terminate your monthly subscription.

11.3 If we terminate your account, you will be notified by email and an explanation of the termination will be provided.

11.4 If a customer interrupts payment for a service, they will be contacted first. If the situation is not corrected, the service will then be interrupted or disabled.

11.5 If your subscription is interrupted before the end of your commitment, you will lose access to future content and any content already broadcast.

Services, Pricing, and Availability

12.1 While every effort has been made to ensure that all general descriptions of the Services available from Psycom match the actual Services that will be provided to you, we are not responsible for variations from these descriptions, as the exact nature of the Services may vary depending on your needs and individual circumstances. This does not exclude our liability in the case of errors due to our negligence and only pertains to variations of the correct Services, not entirely different Services. Please refer to sub-clause 13.8 for incorrect Services.

12.2 Where appropriate, you may be required to select the required Service Plan.

12.3 We do not represent or warrant that such Services will be available at all times and cannot confirm their availability until your Order has been confirmed. Availability indications are not provided on the Website.

12.4 All pricing information on the Website is correct at the time of posting. We reserve the right to change prices and modify or remove any special offers from time to time as needed.

12.5 In the event of price changes during the period between placing an order for Services and our processing of that order and taking payment, the price that was valid at the time of the order will be used.

Orders and Service Provision

13.1 No part of this Website constitutes a contractual offer capable of acceptance. Your order constitutes a contractual offer that we may, at our sole discretion, accept. Our acceptance is indicated by the sending of an order confirmation email. It is only once we have sent you an order confirmation email that there will be a binding contract between Psycom and you.

13.2 If, for any reason, we do not accept your order, no payment will be taken under normal circumstances. In any case, any sums paid by you in relation to that order will be refunded within 14 calendar days.

13.3 Payment for Services will be made via the payment method you have chosen, immediately for any setup fees corresponding to the service plan you have purchased and on the same day of each subsequent month (“billing cycle”) for fees accrued during the previous month’s billing cycle AND/OR as indicated in the order confirmation you have received.

13.4 We aim to fulfill your order within 2-3 working days, unless in exceptional circumstances. If we cannot fulfill your order within a reasonable time, we will inform you at the time of placing the order by a note on the relevant web page or by contacting you directly after the order has been placed. Time is not of the essence of the contract, meaning we will aim to fulfill your order within agreed timelines, but it is not an essential condition of the contract and we will not be liable to you if we do not do so. If the Services are to commence within 14 calendar days of our acceptance of your order, at your express request, you must expressly acknowledge that your legal right of withdrawal, detailed below in Clause 14, will be affected.

13.5 Psycom undertakes to provide the Services with reasonable care and skill, in accordance with best industry practice.

13.6 In the event that Services are provided that are not in conformity with your order and therefore incorrect, you must contact us immediately to inform us of the error. We will ensure that any necessary corrections are made within five (5) working days. Additional terms and conditions may apply to the provision of certain Services. You will be prompted to read and confirm your acceptance of these terms and conditions when completing your order.

13.7 Psycom provides technical support via our online support forum and/or by telephone. Psycom makes every effort to respond in a timely manner, but we do not guarantee a specific response time.

14. Order and Service Cancellation

We want you to be fully satisfied with the Products or Services you order from Psycom. If you need to contact us regarding your order, please contact customer service by email at info@communicationpsycom.com. Subject to Psycom’s discretion, if the timeframe is reasonable, if the order or service has not been consumed or used, we may arrange for a refund. Please note that generally, a shorter period than 30 days facilitates a refund.

15. Privacy Protection

16. How We Use Your Personal Information (Data Protection)

16.1 All personal information we may collect (including, but not limited to, your name and address) will be collected, used, and retained in accordance with the provisions of the 1998 Data Protection Act and the rights conferred upon you by this law.

16.2 We may use your personal information to: 16.2.1 Provide you with our services; 16.2.2 Process your payment for services; and 16.2.3 Inform you of new products and services we offer. You can request us to stop sending you this information at any time.

16.3 In certain circumstances (for example, if you wish to purchase services on credit), and with your consent, we may disclose your personal information to credit reference agencies. These agencies are also bound by the 1998 Data Protection Act and must use and retain your personal information accordingly.

16.4 We will not disclose your personal information to other third parties without having obtained your express permission beforehand.

17.1  In a context where training and advice are applied autonomously, we do not guarantee any specific results resulting from the use of our Service or Services.

17.2 No part of this website is intended to constitute a contractual offer capable of acceptance.

17.3 While we make every effort to ensure that the website is secure and free from errors, viruses, and other malicious software, we strongly advise you to take responsibility for your own internet security, your personal data, and your computers.

18. Modifications to Installations and These Terms and Conditions

If the law requires us to modify these terms and conditions, such modifications will automatically apply to all current orders as well as any orders you place in the future.

19. Website Availability

19.1 The Website is provided “as is” and on an “as available” basis. Psycom employs industry best practices to ensure high uptime, including fault-tolerant architecture hosted on cloud servers. We do not warrant that the Website or the Facilities will be free from defects and/or malfunctions, and we do not provide any refunds for service interruptions. In the case of lifetime access to a service, in the event of the owner’s death or the closure of the business, you would then have a period of four months to download the content you have purchased. We will implement the necessary provisions, and you will be notified in advance.

19.2 We disclaim all liability for any interruption or unavailability of the Website resulting from external causes, including but not limited to ISP equipment failure, hosting equipment failure, communication network failure, power failure, natural events, acts of war, or legal restrictions and censorship.

20. Limitation of Liability

20.1 To the fullest extent permitted by law, we accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special, or exemplary damages arising from the use of the Website or any information contained therein. 20.2 Nothing in these Terms and Conditions excludes or limits Psycom’s liability for death or personal injury arising from any negligence or fraud on the part of Psycom.

20.3 Nothing in these Terms and Conditions excludes or limits Psycom’s liability for any direct or indirect loss or damage resulting from the incorrect provision of Services or reliance on incorrect information included on the Website.

20.4 In the event that any of these clauses are found to be unlawful, invalid, or otherwise unenforceable, that clause shall be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining clauses. This clause shall apply only within jurisdictions where a particular clause is unlawful.

21. No Waiver

If either party to these Terms and Conditions does not exercise a right or remedy provided herein, this shall not be construed as a waiver of such right or remedy.

22. Previous General Terms

In the event of a conflict between these terms and any previous version thereof, the provisions of these terms shall prevail, unless expressly stated otherwise.

23. Third Party Rights

No provision of these terms confers any rights on a third party. The agreement created by these terms and conditions is made between you and Psycom.

24. Communications

24.1 All notifications/communications must be addressed to us by email at info@communicationpsycom.com. Such notification shall be deemed received on the next working day if the email is sent on a weekend or public holiday.

24.2 From time to time, if you choose to receive it, we may send you information about our products and/or services. If you do not wish to receive such information, please click the “Unsubscribe” link in any email you receive from us.

25. Law and Jurisdiction

These General Terms and the relationship between you and Psycom shall be governed and construed in accordance with the laws of England and Wales, and Psycom and you agree to submit to the jurisdiction.
